Terms and Conditions

All transactions between you, the buyer or company, and OZ Star Surgical, or between you and us in any other capacity as our client, shall be governed by the following terms and conditions.

Quotations

1. All quotations and offers made by OZ STAR Surgical are subject to these Terms.
2. Quotations are valid for 30 days unless otherwise stated in writing.
3. Price quotes are specific to each order and do not include delivery, freight, or insurance costs unless explicitly stated.

Orders

1. Your order, once accepted by OZ STAR Surgical orally or in writing, constitutes a binding contract governed by the laws of the State of Victoria.
2. Orders cannot be cancelled or altered without OZ STAR’s Surgical written consent, which may include payment of cancellation or alteration fees.

Price

1. Prices quoted by OZ STAR Surgical are subject to change before order acceptance.
2. The Buyer is responsible for all taxes, including GST, as applicable.

Performance & Delivery

1. OZ STAR Surgical is not liable for delays or failures in performance or delivery due to circumstances beyond its control.
2. Delivery times are estimated and not guaranteed unless explicitly stated in writing by OZ STAR Surgical.

Returns & Credits

1. Goods may be returned for credit within 30 days of invoice date, provided they are in original condition and packaging.
2. No credit will be issued for custom-made, embroidered, or worn goods.
3. The Buyer bears the cost of returning goods for credit.

Terms of Payment

1. Goods remain the property of OZ STAR Surgical until full payment is received.
2. Unless otherwise agreed, payment terms are nett thirty (30) days from end of month (EOM).
3. OZ STAR Surgical may charge interest on overdue amounts.

Warranties & Liabilities

1. OZ STAR Surgical supplies goods and services based on Buyer’s specifications; no liability is assumed for suitability of goods for Buyer’s purposes.
2. Advice provided by OZ STAR Surgical is given in good faith but does not constitute liability.
3. Warranty for goods supplied by subcontractors or suppliers is limited to the warranty honoured by them.

Waiver

1. Failure to enforce any provision of these Terms does not constitute a waiver.
2. Waivers must be in writing and signed by OZ STAR Surgical to be valid.

Insurance

1. Goods or materials provided by Buyer are at Buyer’s risk.

General

1. Buyer agrees to pay for goods and services supplied by OZ STAR Surgical.
2. Guarantors are jointly liable for all obligations under these Terms.
3. Disputes must follow OZ STAR’s Surgical dispute resolution process.
